O direito e as novas tecnologias: a segurança digital como (novo) direito humano

Abstract

The emergence of new technologies and the sharing of information through the World Wide Web has brought significant changes in society and social behavior. From the expansion of the use of Internet tools, communication to ecommerce by establishing the guardianship of primordiality relationships in the information society. The present study about cyber security as a new Human Right seeks to examine the evolution of the information society and the human condition in contemporary human translocation to the space caused by the use of the World Wide Web, which is relationships, the virtual space. The research is justified because of the new aspects of law enforcement in the virtual society. In this sense, the law, in addition to discipline and protect the new situations, needs to adapt the technology trend in the service of effective and efficient protection of legal certainty and protection, fostering and promoting human rights. As an initial hypothesis will be adopted as a premise that digital security, data protection in virtual space and the exercise of citizenship are embodied in virtual projection condition worthy of the man and the movement of the Royal Society for the virtual does not authorize the abandonment of full protection to humans, and even in the invasion of the rights and guarantees to digital security and existing human rights aimed at the full development of human beings. Therefore, the research agenda will be the method of hypothetical-deductive approach, based on literature and documents, and the historical, comparative and typological procedure since the evolution of the information society will be investigated as a social process complex.
